Court orders Toke Makinwa to pay ex-husband N1m for defamation

A Lagos High Court at the Tafawa Balewa Square has ordered On Air Personality (OAP) Omotoke popularly called, ‘Toke’ Makinwa to pay her ex husband, Maje Ayida N1 million for defamation. 

Justice Olukayode Ogunjobi held that Ms. Makinwa made the defamatory statements in her 2016 book “On Becoming” published by Kachifo Ltd.  Both persons are first and second defendants.

Justice Ogunjobi held that “after a careful consideration of the evidence before the court,” it found only the contents of page 54 line 11-16 and page 83, Line 1 of the 1st defendants’ book as defamatory. 

The court found that Toke’s claim in those portions of the book that she gave Mr Ayida N2,000 to give to his girlfriend and that she got a sexually transmitted infection through him in the past, were unproven.

The Court awarded N500,000 as damages against each of defendants to any charity organisation of the plaintiff’s choice. 

The court also granted an injunction preventing the defendants from producing copies of the book with the defamatory words, and he gave them 30 days from the day of judgment to delete and remove the said defamatory words from unsold copies of the book in their custody.

Mr Ayida filed the suit filed in 2017 marked through his counsel Kemi Pinheiro SAN, alleging that the facts were false, malicious and designed to tarnish his Image as a reputable columnist and professional in the Health and Wellness Industry.

Toke’s lawyer, Adeyinka Olumide-Fusika had averred in his written address before the judgment that the facts are a true reflection of Maje Ayida’s person.
